Surrogacy in Ukraine in 2026

The short answer

Surrogacy in Ukraine is limited to married heterosexual couples with a genetic link to the embryo and a medical need. Foreign couples have been able to take part, but a bill registered in August 2026 could end that, and the US advises against all travel to Ukraine.

The US State Department rates Ukraine Level 4: Do Not Travel. Bill No. 15507, registered in August 2026, proposes barring foreigners from surrogacy unless one spouse is a Ukrainian citizen. Transition rules have been proposed for existing agreements, but the bill’s outcome is unknown. Talk to us and to independent counsel before you commit.

Who qualifies

  • A married heterosexual couple
  • A genetic connection to the embryo
  • A medical need for a surrogate

How parentage works

Ukrainian law sets out who the parents are, and the surrogate is not listed as a parent on the birth certificate. Parents then complete embassy procedures, citizenship documents and the exit process.

What programs include

Programs are highly regulated and clinic-based, so medical costs are usually integrated into one package. Surrogates are usually contracted through an agency. Base compensation typically begins only after a heartbeat is confirmed.

Why we still talk about Ukraine

We have worked in Ukraine through the war, and we stayed with our families and surrogates when many left. That experience is also why we won’t gloss over the risks.
