Surrogacy in Mexico

The short answer

SMARTPath’s Mexico programs frequently start around $59,000 to $75,000 and welcome couples, single parents and LGBTQ+ families. We often match parents within 2 to 4 months. Rules differ by state, so legal steps must be planned before embryo transfer.

Why parents choose Mexico

  • Lower total cost. Packages often include IVF, surrogate compensation, legal contracts and delivery in one price.
  • Inclusive matching. We match with surrogates open to working with diverse families.
  • Shorter waits. We frequently match within 2 to 4 months, though timelines vary.

The legal process

Mexico has no single national surrogacy process. State laws differ, and Supreme Court decisions shape how they apply. In June 2021 the Court struck down parts of Tabasco’s surrogacy rules, including a requirement for a partner’s consent. Your route depends on your state, your family and your home country.

  • Amparo: a legal procedure that can play a role in establishing parental rights.
  • Contract ratification: the right documents need to be in place before embryo transfer.
  • DNA testing: this may be necessary, depending on your legal pathway.
  • Personal appearance: some steps can use a power of attorney, while others can’t.

Mexico surrogacy questions, answered

Is surrogacy legal in Mexico?

Surrogacy in Mexico is possible, but there is no single national process. Requirements vary by state, and Mexico’s Supreme Court has issued important decisions on reproductive autonomy, discrimination and the rights of children and surrogates.

How much does surrogacy in Mexico cost?

SMARTPath’s Mexico programs frequently start around $59,000 to $75,000. Final cost depends on medical, legal and travel factors. Extras can include biotransport, additional testing, rematching, extra embryo transfers, passport or citizenship steps and your own travel.

How are payments structured?

Medical, legal and program management fees are paid to SMARTPath through a US bank. Surrogate compensation is paid directly by intended parents, following the schedule in the surrogacy agreement.

Can I pay by credit card?

Agency and medical payments can be made by credit card with a 3.5% processing fee, or by wire transfer and other US-based methods. Surrogate compensation cannot be paid by credit card.

How are surrogates in Mexico screened?

Every surrogate completes a multi-step review: OB history, psychological evaluation, infectious disease testing, drug and nicotine screening, and confirmation of a stable home and support network.

How is the pregnancy monitored?

Surrogates follow a structured prenatal schedule with regular OB visits, ultrasounds and lab checks. Drug and nicotine tests are unannounced. Parents receive medical updates and ultrasound results.

How involved can we be if we are not in Mexico?

Very involved. You can receive regular summaries and ultrasound images or videos, join key appointments by video, and stay in touch through your coordinator.

Who makes medical decisions during the pregnancy?

Decisions follow a shared structure set out in the agreement. Intended parents direct care of the pregnancy and baby. The surrogate keeps full autonomy over her own body and health, and the medical team oversees treatment.

When are contracts signed?

The surrogacy agreement is completed before any embryo transfer or medical steps for the surrogate.

What happens with the birth certificate?

A local attorney handles the filings to register your baby’s birth in Mexico. We prepare the documents with you before delivery, then you move on to the steps your home country requires.

How long do parents stay after the birth?

Many families stay a few weeks, but it depends on your citizenship, your embassy and how busy local offices are. We discuss your likely timeline early. Most parents stay in a hotel or short-term apartment.

Does SMARTPath help with the embassy?

Yes. We help you prepare documents, understand what your embassy will ask for, and stay on track while you complete your country’s requirements.
